Applied Medical Resources Corp. v. United States Surgical Corp. (Covidien)

The U.S. District Court for the Central District of California found that “trocar” products from United States Surgical, a subsidiary of Analysis Group client Covidien, do not infringe on a patent held by Applied Medical Resources Corporation. Surgeons use trocar devices to help access the abdomen during laparoscopic procedures.

Covidien’s counsel Bartlit Beck and Paul Hastings retained Analysis Group to conduct a damages analysis of the alleged patent infringement. A case team including Managing Principals Keith R. Ugone and Jeffrey H. Kinrich, and Vice Presidents Michael Beauregard and Andrew Stichman provided substantial deposition and trial support to counsel. Dr. Ugone prepared an expert report and provided deposition and trial testimony.

After a five-week trial, a unanimous jury found for Covidien – eliminating as much as $400 million in potential financial exposure, according to Wall Street analysts.
