Class Action Litigation
We have assisted clients in class action matters in numerous industries, performing analyses and testifying at deposition and trial.
Frequently, we focus on assessing the economic underpinnings of commonality and typicality arguments. Our analyses illustrate how causation and damages may require individualized assessments, as opposed to those based on common methods of proof for the entire class.
Analyzing the Class
An overview of our consultants' and affiliates' recent case work, publishing, and presentations on emerging issues in class certification.
We have provided support to leading academic experts in developing these arguments. Our analyses include attention to:
- Commonality of facts and implications for using common methods of proof
- Whether all members of the class have suffered economic injury, assuming liability
- Representativeness of the named plaintiffs
We also assist in settlement talks and settlement agreements to ensure targeted and appropriate relief to damaged class members.
Analysis Group has considerable experience in the defense of class action securities lawsuits, including one of only a few securities fraud class action trials to go to a verdict in the past decade.
We employ a range of approaches, including statistical methodologies, to examine the relative benefits and risks associated with use of a product and the relative prevalence of damages among users and non-users of the product. We have also conducted analyses that identify conditions consistent with alternative causes of the alleged damages.
