Mr. Clarke provides financial and economic consulting services to clients in various industries, as well as the U.S. government, in both litigation and non-litigation contexts. His engagements have spanned a variety of subject areas, including intellectual property, commercial disputes, valuation, securities, and antitrust and competition. Mr. Clarke has consulted in IP matters involving patent and trade secret claims before district courts and the U.S. International Trade Commission (ITC), and has been retained as a testifying economic expert in Section 337 investigations before the ITC. Mr. Clarke has experience in commercial disputes involving breaches of contract, tax controversies, insurance recovery, and fraudulent conveyance, and has analyzed both liability and damages for antitrust and competition engagements. He has also assessed mutual fund market timing, stock option backdating, and general 10(b)5 violations in securities litigation, and evaluated class certification issues arising in consumer fraud matters. His non-litigation consulting work has included helping to develop payment algorithms for claims related to environmental disasters and advising clients on antitrust concerns related to potential acquisitions. He has published expert analysis in Law360 on topics such as standard essential patents, IP damages, and the ITC.
Mr. Clarke served as an economic consultant for 15 years prior to joining Analysis Group. He has earned the right to use the Chartered Financial Analyst designation.
