Brand Name Prescription Drug Litigation

Since 1995, an Analysis Group team, including Senior Advisor Tamar Sisitsky and Principal Almudena Arcelus, has supported several academics, including Analysis Group affiliate Robert Pindyck and Professor Ernst Berndt, on behalf of a large group of pharmaceutical manufacturers accused of price discrimination and price fixing. Independent retail pharmacies and drug store chains have alleged that they have been harmed by manufacturers' pricing practices. We have analyzed the economics of this industry, including determinants of manufacturers' transaction prices, the economics of formulary practices, and the relationships among key decision makers. We have also evaluated plaintiffs' experts' approaches to assessing liability and damages.
