The laws surrounding patent damages are rapidly evolving, and the viability of damages theories is increasingly unpredictable. To assist litigants and district courts, The Sedona Conference's Working Group 9 on Patent Damages and Remedies (WG9) has developed a Proposed Model Local Rule for Damages Contentions, as well as a framework for early damages-focused hearings. Managing Principal John C. Jarosz joins a notable panel of judges and attorneys to discuss how litigants and courts around the country may bring efficiencies to patent litigation by incorporating these best practices into appropriate cases.
