Economists frequently are called upon to evaluate damages in IP litigation before the federal courts, but what is the role of economic analysis in proceedings before the International Trade Commission (ITC), given that money damages are not an available remedy?

Companies named in these suits, or facing regulatory investigation of backdating practices, will work with outside counsel to assess their exposure and determine defense approaches. They will also require the expertise of economists to analyze option grants using statistical techniques developed by academics, examine the components of financial exposure, and assess direct and indirect damages associated with backdating.
