2012 ABA Antitrust Spring Meeting
The Complexities of Pricing, Contracts, and Competition 

      

Companies rise and fall on their ability to effectively set and compete on price. Firms may use discounts to lure customers away from rivals; they may bid up input prices to compete for scarce resources. But at what point do their behaviors cross over from competitive to anticompetitive – particularly when their actions are considered against recent changes in pricing laws and antitrust guidelines? Several Analysis Group consultants and one of our affiliates will examine this question at the 60th annual Spring Meeting of the American Bar Association’s Antitrust Section.

Deal Assessments: Which Economic Factors Are Key?
Managing Principal Tasneem Chipty explored this question in a presentation before the Minnesota State Bar Association. The 2010 Horizontal Merger Guidelines emphasize the usage of “evidence of competitive effects.” They de-emphasize “market definition” as a key factor in economists’ assessment of deals. After considering how the guidelines have been implemented in recent cases, however, it's clear that both factors are relevant, says Dr. Chipty.

A Canadian judge issued a summary judgment in favor of Analysis Group client Tim Hortons, Inc., dismissing claims by a putative class of franchisees that the Canadian coffee and doughnut franchisor was engaged in price-fixing and other anticompetitive conduct.

Micron Gets Favorable Decision in
Antitrust Case
 

Analysis Group client Micron Technology received a favorable decision from a California jury in an antitrust lawsuit filed by Rambus, Inc. Rambus alleged that the defendants had engaged in acts to stifle competition and innovation in the market for memory chips.

In re OnStar Contract Litigation
Asserting consumer protection act and warranty claims, a putative class of car buyers and lessees alleged that the defendants, OnStar and several automakers, continued to sell analog-only OnStar systems in vehicles knowing that the equipment would eventually stop working.

Assessing Competition in the Telecommunications Industry 
Analysis Group was retained by Mayer Brown LLP on behalf of AT&T to comment on the potential harm to consumers from delaying the company’s entry into a market that was served by only one provider of video services.

AG Research in the News 

Consultants from our Energy practice are looking closely at questions that regulators and others in the energy sector need to answer regarding natural gas production and the evolution of hydraulic fracturing regulations, and the economic impact of a 10-state regional greenhouse gas initiative.

Several other AG consultants and one of our affiliates explore factors for economic recovery in their articles on the effect of privacy policy changes on venture capital and innovation and the role that mobile broadband can play in reviving the U.S. economy.
