The Department of Justice, along with the Federal Trade Commission, released new guidance on anti-poaching and wage-fixing agreements in October 2016. The guidance was designed to help companies, human resource professionals, and others involved in hiring and compensation decisions, in complying with applicable antitrust laws, warding off potential violation risks, and protecting their key employees from competitors. Employers, including individual employees who are involved into certain "naked agreements," will be criminally investigated and prosecuted by the DOJ.
Vice President Shannon Seitz will participate in a panel discussion that will present an in-depth analysis of the fundamentals, recent trends, and developments in anti-poaching and wage-fixing agreements. Discussion topics will include prohibitions and restrictions, restraint of trade, hiring and compensation standards, and best practices to mitigate antitrust risk.
