In this webinar, Manager Kristof Zetenyi will join a panel to discuss the use of statistical sampling as evidence to support class certification. Dr. Zetenyi and his co-panelist will discuss recent cases in which statistical sampling methods were successfully used as evidence, including the US Supreme Court decision in Tyson Foods, Inc. v. Bouaphakeo. They will also discuss cases in which courts have found this methodology to be unreliable for the determination of liability, such as Duran v. U.S. Bank National Association. Given the uncertainty facing litigators over the parameters of what can be used as evidence, Dr. Zetenyi will provide insight on common pitfalls of statistical sampling and tips for successful implementation.
