In this webinar, Vice President Jee-Yeon Lehmann will participate in a panel discussion on no-poaching agreements, which have come under increased scrutiny after the Federal Trade Commission (FTC) and US Department of Justice (DOJ) Antitrust Division jointly issued the document “Antitrust Guidance for Human Resource Professionals,” prohibiting certain types of wage-fixing and no-poaching agreements. These agreements, unlike traditional non-compete and confidentiality agreements between employers and individual employees, are between employers or companies themselves. According to FTC and DOJ guidance, naked wage-fixing and no-poaching agreements are considered to be antitrust violations of the Sherman Act. 

Dr. Lehmann and her co-panelist will discuss the risks for employers in entering a no-poaching agreement and offer best practices for compliance in light of the increased scrutiny in enforcement. Additionally, the panelists will discuss key takeaways from recent enforcement actions.
