Experts from Analysis Group and Sidley Austin Explain Considerations for the Use of Statistical Sampling in False Claims Litigation

Analysis Group Managing Principal Jeff Cohen and Vice President Mihran Yenikomshian joined Partner Scott Stein and Associate Brenna Jenny of Sidley Austin LLP to conduct a webinar on the use of statistical sampling in establishing proof of liability in litigation brought under the False Claims Act. The economics and legal experts outlined the basic statistical principles and process employed in estimating damages, including the risks associated with sampling, some common types of errors that can invalidate the process, and the circumstances that make sampling more or less appropriate for a case. The team also discussed recent case law involving the use of sampling, and explored the potential for sampling methodologies to be applied in class certification.
