Class Issues Involving the Collection of Biometric Data

Analysis Group was retained by the defendants in class actions involving a breach of the Illinois Biometric Information Privacy Act. This work involved evaluating whether the defendants failed to disclose and acquire consent to collect and store employees’ biometric information, such as finger-scan data. Our internal consultants served as experts on the statistical methods used to establish the size of the classes. We also evaluated the specific hardware and software used for data collection to determine whether biometric data was stored and, if so, whether this data varied across the proposed classes.
