Deceptive Conduct Litigation Related to Consumer Data
Analysis Group was retained on behalf of a social network and a web analytics company, the respondents in a litigation brought by a government competition regulator that claimed that the respondents engaged in false, misleading, or deceptive conduct when the social network promoted a virtual private network (VPN) software application developed by the web analytics company. The government alleged that the respondents misled consumers by representing that the VPN application would keep users’ personal activity data private, but then collected user data for the social network’s commercial benefit. Our team supported two affiliated experts, who evaluated both technical and economic aspects of the allegations made by the government.
