Evergy Inc., et al. v. BNSF Railway Company

Analysis Group was retained on behalf of the railroad company Burlington Northern Santa Fe Railway Company (BNSF), the defendant in contract proceedings brought by electric utility company Evergy and its affiliates before the US Surface Transportation Board. The dispute stemmed from a contract under which BNSF transported coal to Evergy’s generating stations in Missouri and Kansas. Evergy alleged that BNSF refused to allow the utility to place into service the number of private railcar trainsets needed to meet Evergy’s reasonable transportation requirements for coal, and the service failures caused substantial economic harm, including lost profits and opportunity costs.

An Analysis Group team led by Managers Grace Howland and Daniel Stuart supported Principal Paul Hibbard, who provided testimony regarding issues associated with electricity markets and power system modeling.
