FERC Proceeding - Basin Electric Power Cooperative/McKenzie Electric Cooperative

An Analysis Group team worked with McKenzie Electric Cooperative, the intervenor in proceedings before the Federal Energy Regulatory Commission (FERC) concerning the Basin Electric Power Cooperative’s (BEPC’s) rate schedules. The team, which included Vice President Megan Accordino and Manager Daniel Stuart, supported Principal Paul Hibbard, who provided expert testimony before the commission on the appropriateness, in light of standard regulatory principles, of including costs associated with the Dakota Gasification Company (DGC), a non-utility asset, in regulated utility rates. Mr. Hibbard evaluated whether DGC was used – and useful – in providing regulated electric service and the prudence of the decision-making process that led to investments in the facility. Mr. Hibbard’s testimony was cited repeatedly by the administrative law judge in his initial decision that BEPC was obligated to remove all costs associated with DGC from its regulated rates.
