Jennifer Gifford, et al. v. Air Canada

Analysis Group was retained on behalf of the joint defense group in a Canadian antitrust class action brought on behalf of consumers who purchased transborder airline tickets. The plaintiff alleged that the defendant airlines conspired to fix the prices of air travel between Canada and the US by suppressing the supply of air travel capacity, thereby inflating airfares.

An Analysis Group team led by Managing Principal Dov Rothman and Vice President David Toniatti supported academic affiliate James Levinsohn, who filed an expert report and testified at deposition. Professor Levinsohn analyzed economic issues related to class certification.

A judge in the Ontario Superior Court of Justice denied certification of the class, holding that the plaintiff had not established several of the necessary criteria.
