Steve Rabin, et al. v.  Google LLC

Analysis Group was retained by Cooley on behalf of Google, the defendant in a consumer class action alleging breach of contract. The plaintiffs were commercial users of Google’s cloud-based productivity and collaboration suite, Google Apps, who enrolled between 2006 and 2012. The plaintiffs alleged that Google breached its promise to provide customers with free access to the suite in perpetuity.

Principal Hristina Bojadzieva Bartlett filed reports and testified on damages and class certification issues in both the class certification and merits phase of the case. She was supported by an Analysis Group team led by Vice President George Derpanopoulos.

Academic affiliate Arun Sundararajan filed reports and testified in the merits phase on whether terminating a free product offering was consistent with industry practices, the economic rationale for temporarily providing free software offerings before transitioning users to a paid product, and the availability of alternatives to consumers. He was supported by an Analysis Group team led by Vice President Kristof Zetenyi and Manager Jessica Burley.

A judge in the US District Court for the Northern District of California granted Google’s motion for summary judgment.
