Global Competition Review Recognizes Analysis Group as an Outstanding Global Economic Consulting Firm

Once again, Global Competition Review (GCR) has identified Analysis Group as a leader in the world of competition economics in its GCR 100. The annual rankings highlight top antitrust economic consulting firms, evaluated by size of practice, reputation, and work on impactful competition matters during the previous year. Among other things, GCR noted the recent addition of Competition Expert Pierre Régibeau, former chief competition economist at the European Commission’s Directorate-General for Competition (DG COMP).

Federal Trade Commission, et al. v. The Kroger Company, et al.

Analysis Group assisted the Federal Trade Commission (FTC) in its review of the proposed $24.6 billion merger between Kroger and Albertsons, the first- and second-largest supermarket retailers in the US, respectively. The firm supported two experts, who addressed the claimed efficiencies that would result from the merger and the divestiture plan. The parties abandoned the transaction after the district court granted a preliminary injunction, finding that the FTC was likely to prevail on its claim that the merger would harm competition in the retail grocery market. GCR named Managing Principal Aaron Yeater Economist of the Year for his testimony on the claimed efficiencies of the merger.

Methanex’s Acquisition of OCI Global

Analysis Group supported Methanex, a large Canadian producer and distributor of methanol, in connection with its planned acquisition of OCI Global’s international methanol operations. Our team assisted with Methanex’s submissions to US, UK, and EU regulators by examining production capacity, global pricing, transportation costs, and market entry and exit. The merger was cleared in the US without divestitures and cleared without remedies at Phase 1 by DG COMP.

European Commission Investigation of Gucci

Analysis Group provided economic consultation to Italian luxury fashion brand Guccio Gucci SpA related to the European Commission’s investigation into its alleged resale price maintenance (RPM) practices. Gucci was accused of imposing the retail price at which independent multi-brand retailers sell Gucci products, including handbags and leather goods. An Analysis Group team worked on a market study of the luxury industry and on the information conveyed by prices in this sector, as well as on a theoretical model of RPM in the luxury industry.

Regeneron Pharmaceuticals, Inc. v. Amgen, Inc.

Analysis Group assisted Regeneron Pharmaceuticals in its lawsuit against competitor Amgen. Regeneron alleged that Amgen unfairly undercut sales of Regeneron’s cholesterol-reducing biologic by illegally bundling its competing drug with rebates for discounts on an unrelated drug. Our expert testified at trial, assessing damages associated with Amgen’s alleged anticompetitive conduct. A jury found in Regeneron’s favor and assessed compensatory damages in the exact amount calculated by our expert, as well as punitive damages.
