Analysis Group is pleased to announce Principal Jessica Resch’s recognition by Lexology (formerly Who’s Who Legal) as a thought leader in global arbitration. The Lexology Index Thought Leaders: Arbitration report described Ms. Resch as “a distinguished expert renowned for her vast experience advising clients on the quantification of damages in complex cross-border litigation and arbitration proceedings.”
The Lexology Index report publishes interviews with profiled leaders, who are selected based on recommendations from client interviews and quantitative data on track record and experience. The report describes the highlighted practitioners and expert witnesses as notable for their vast expertise and experience and their innovative work on some of the world’s most significant and high-profile disputes.
In her interview, Ms. Resch discussed her approach to valuation, noting that there is no one-size-fits-all method. “My process considers several key factors: the industry context, the stage of development of the asset or company, and the nature and reliability of available information,” Ms. Resch explained. “The goal is to identify a methodology that aligns with economic reality, is well-supported by evidence, and stands up to scrutiny.”
She also reflected on how the pace of technological change and uncertainty around climate policy could impact international arbitration, suggesting that shifts in policy could fuel disputes over valuation. “I anticipate interesting questions about whether policy changes that cause assets to lose value violate fair and equitable treatment rules, and how to appropriately calculate the value of oil and gas assets that appear valuable today but may become far less so in the future.”
