Summary of Experience

Ms. Offner specializes in the application of economics, consumer behavior, and marketing research methods to litigation matters and strategic business problems. Her experience encompasses issues related to consumer behavior in a variety of false advertising, IP, Lanham Act, data privacy, and other commercial disputes and damages matters. She has experience across a wide variety of industries, such as consumer products, financial services, software and digital platforms, technology, real estate, media and entertainment, and food and beverage.

Ms. Offner has extensive experience supporting marketing authorities in the development, administration, and analysis of surveys and other data-driven approaches in litigation matters, including those used to study consumer perceptions of marketing statements, the impact of marketing statements on consumer purchase behavior, the importance of product attributes to consumer choices, and consumer confusion due to trademark infringement. Across litigation matters, she has supported experts through all phases of the litigation process, including preparation of expert reports, depositions, and trial testimony. Ms. Offner has also submitted signed declarations in two matters.

Ms. Offner also has experience with mass arbitrations, including those related to allegations of false advertising, privacy violations, and data breaches. In these matters, she has used her expertise in analyzing large, complex datasets to determine the merits of plaintiffs’ claims, the nature and extent of the alleged harm, and the quantification of damages, and to provide support for arbitration proceedings and settlement negotiations.
