Jon Hart, et al. v. TWC Product and Technology LLC

Analysis Group was retained on behalf of TWC Product and Technology (TWC), the owner of The Weather Channel app and the defendant in a privacy class action suit. The plaintiffs, California residents who downloaded the app, alleged that TWC collected, maintained, and profited from consumers' geolocation data through the use of the Weather Channel App, in part by selling the data to third parties. They sought certification to sue as a class for monetary damages.

An Analysis Group team led by Manager Alexander Graupner supported Principal Hristina Bojadzieva Bartlett, who filed two expert reports on class certification and damages topics. Specifically, Ms. Bartlett opined on the plaintiffs’ expert’s methodology for calculating damages and whether it could reliably produce class-wide damages in accordance with the plaintiffs’ theory of liability.

A judge in the US District Court for the Northern District of California denied certification of the proposed class. The case subsequently settled.
