Koch Industries, et al. v. Government of Canada

Analysis Group was retained on behalf of Koch Industries and Koch Supply & Trading, the claimants in an international investor-state dispute settlement (ISDS) arbitration filed against the Canadian government. Ontario cancelled its greenhouse gas cap-and-trade program in alleged violation of the North American Free Trade Agreement. Cancellation of the regulation caused the claimants’ allowances – purchased from the government weeks prior – to lose all value. 

An Analysis Group team led by Principal Todd Schatzki supported academic affiliate Robert Stavins in assessing economic and regulatory issues related to the cancellation of the regulation and the loss of economic value.
