Report on the Implications of Uber’s Paying the National Living Wage on P1 Time

In 2021, the Supreme Court of the United Kingdom determined that drivers for the Uber ride-sharing app must be paid the country’s hourly national living wage (NLW). That decision left open the question of the period over which the NLW should be calculated: Should it begin when a driver turns on the Uber app or only when a driver accepts a driving assignment and picks up a passenger?

Uber retained Analysis Group academic affiliate Oliver Hart to author a white paper to evaluate the potential implications for Uber’s business model of a more expansive obligation on Uber as it relates to working time – in particular, the impact such an obligation would have on the flexibility that Uber drivers have to determine their own driving time and schedules.
