Principal Hristina Bojadzieva Bartlett and Affiliate Keri Pearlson Join Analysis Group–Cohosted Panel on Cybersecurity and Arbitration During New York Arbitration Week

Principal Hristina Bojadzieva Bartlett and academic affiliate Keri Pearlson joined the Analysis Group and Crowell & Moring panel “Cybersecurity and Arbitration: Emerging Threats and Evolving Standards” during New York International Arbitration Week. The panel was moderated by Randa Adra (Crowell & Moring) and also included Mark Morril (Morril ADR) and Andrew Erber (Honeywell).

Panelists began by sharing insights on the evolving landscape of cyberthreats and risk, discussing the uptick in the frequency and sophistication of cyberattacks, the role of humans and AI in security breaches, and corporate strategies for building resilience to cyberthreats. Reflecting on the surge in disputes involving cybercrime, panelists noted the frequent need for multiple experts in such matters and the complexity of establishing liability and quantifying harm when responsibility for the breach may be shared, such as in disputes where multiple events within the purview of different parties might have contributed to the data breach. Despite rising litigation in this area, multiple panelists suggested that arbitration may be a preferable forum for resolving cybersecurity disputes, especially B2B ones, given the confidential nature of the proceedings, the ability to appoint an expert tribunal, and party autonomy to tailor the expert process to the facts of the dispute.

The discussion concluded with practical lessons for firms and practitioners around cybersecurity and related disputes, including bringing the topic of cybersecurity to the forefront of firm conversations and taking steps to manage risk.
