Vice President Michael Carson Discusses Strategic Considerations for Using Experts in Life Sciences Patent Litigation at ACI Forum

Vice President Michael Carson discussed strategic considerations for selecting and engaging expert witnesses during the “Expert Opinion or Opinion on Experts?” panel at the American Conference Institute’s (ACI’s) Forum on Pharma & Biotech Patent Litigation USA.

Mr. Carson and his co-panelists described how early engagement of experts can strengthen case strategy and refine legal theories before trial. Drawing on Analysis Group’s experience supporting a wide range of experts, Mr. Carson discussed the importance of aligning expert scope with case needs, balancing the costs of experts with the value that they can provide, and maintaining clarity in complex scientific and economic testimony. The panelists also discussed the role of survey and market research methodologies in evaluating perceptions, decision making, and the value of at-issue product features.
