California Consumer Privacy Act:
Privacy Notice for California Residents

California residents have certain rights under the California Consumer Privacy Act (“CCPA” or the “Act”) regarding the collection and use of their personal information by Analysis Group, Inc. and our subsidiaries and affiliates (“Analysis Group”, “we”, “our”, “us”).  This CCPA Privacy Notice (the “Notice”) supplements the information contained in our Website Privacy Statement by providing additional information about how we collect, use, disclose, and otherwise process personal information of individual residents of the State of California. Unless otherwise expressly stated, all terms defined in our Website Privacy Statement retain the same meaning in this Notice and all other terms defined in the CCPA and not otherwise defined in this Notice have the same meaning when used in this Notice. For purposes of this Notice, the term “personal information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. For the purposes of this Notice, personal information does not include:

  • Publicly available information from government records.
  • Deidentified, aggregated or anonymized information that is maintained in a form that is not capable of being associated with or linked to you.
  • Information excluded from the CCPA's scope, such as information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA), the California Confidentiality of Medical Information Act (CMIA), the Fair Credit Reporting Act (FRCA), the Gramm-Leach-Bliley Act (GLBA) or California Financial Information Privacy Act (FIPA), and the Driver's Privacy Protection Act of 1994.
  • Information relating to our employees, contractors and other staff.

To the extent that any other provision of the Analysis Group Website Privacy Statement conflicts with a provision of this Notice, the provision in this Notice controls as to California residents. 

CCPA PRIVACY RIGHTS

California residents may:

  • Request information about:
    • the categories and specific pieces of personal information we have collected about you;
    • the categories of sources from which we have collected your personal information;
    • the business or commercial purpose for collecting or selling your personal information;
    • the categories of personal information we have sold about you; and
    • the categories of third parties with whom we have disclosed for a business purpose, or sold your personal information, and which categories of personal information we have sold to which categories of third parties.
  • Request that we delete their personal information.
  • Opt-out of the sale of their personal information.

You also have the right to be free from discrimination for exercising any of the rights described above. We will not discriminate against you for exercising your rights under the CCPA.  

Please note that if the exercise of the rights described above limits our ability to process personal information (such as in the case of a deletion request), we may not be able to provide our services to individuals who exercise these rights, or to otherwise engage with such individuals going forward.

EXERCISING YOUR RIGHTS

Requests for Information

California residents may request that we provide certain information about our use of their personal information, as specified above, by contacting us at 866-425-0020 or AGPrivacy@analysisgroup.com.

Before processing your request for information, we will need to verify your identity and confirm you are a resident of the State of California. In order to verify your identity, we will generally require the matching of sufficient information you provide us to the information we maintain about you in our systems. This process may require us to request additional personal information from you, including, but not limited to, your name, email address, postal address, date of your last interaction with us, and the general nature of your interactions with us.  If we are able to verify your identity, we will respond to your request by: (a) providing the requested information; or (b) explaining to you why the Act does not require us to provide the requested information.

We have no obligation to provide personal information to you more than twice in a 12-month period.  If a request or series of requests are manifestly unfounded or excessive, we may charge a reasonable fee for processing the request(s), or may refuse to process the request(s).

Requests to Delete

California residents may request that we delete their personal information by contacting us at 866-425-0020 or AGPrivacy@analysisgroup.com.  Upon receiving a request from you, we will take the above steps to verify your identity.  If we are able to verify your identity, we will respond to your request by: (a) deleting your personal information and, if applicable, directing our service providers to delete your personal information; or (ii) explaining why the Act does not require us to delete your personal information.

If a request or series of requests are manifestly unfounded or excessive, we may charge a reasonable fee for processing the request(s), or may refuse to process the request(s).

Requests to Opt Out

We do not currently sell personal information triggering the Act’s opt-out requirements.  We do allow certain service providers, like Google Analytics, to collect information about consumers directly through our Site for purposes of analyzing and optimizing our Site and services.  You may opt out of Google Analytics here.

Authorized Agents

In certain circumstances, California residents are permitted to use an authorized agent to submit requests to know or delete personal information on their behalf through the designated methods set forth in this Notice, where we can verify the authorized agent’s authority to act on their behalf by:

  • receiving a power of attorney valid under the laws of California from the consumer or their authorized agent; or
  • receiving sufficient evidence to show that the consumer has:
    • provided the authorized agent signed permission to act on their behalf;
    • verified the consumer’s own identity directly with us pursuant to the procedures set forth in this Notice; and
    • directly confirmed with us that the consumer provided the authorized agent permission to submit the request on their behalf.

Minors

If we have actual knowledge that you are under 16 years of age, we will not sell your personal information unless you – or, if you are under 13 years of age, your parent or guardian – affirmatively “opt in” to the sale of your information.

PERSONAL INFORMATION WE HAVE COLLECTED, SOLD, OR DISCLOSED

In the preceding 12 months, we have collected the following categories of personal information about California residents:

We use this information to communicate with you; to provide you with information and materials about our products, services and events; for the performance of a contract or furtherance of a business relationship between us; and for systems improvements and maintenance.   

California Customer Records (Cal. Civ. Code § 1798.80(e)), including your credit or debit card, bank account, and income information. 

You may provide some of this information to Analysis Group or our service providers in connection with our provision of services to you.

We use this information to receive funds from you in connection with our services or a contract between us; and for tax purposes.

Professional/Employment Information, including your job title or current employer.

You may provide this information to Analysis Group or our service providers when you visit our website, request that we provide you with information and materials about our products, services, and events, or communicate with us via telephone, email or our website.

We use this information to communicate with you; and to provide you with information and materials about our products, services and events.

Internet/Network Information, including your browsing history, search history, cookie data, your usage information (such as the actions you take and the content you view on Analysis Group’s website).

You may provide this information to Analysis Group or our service providers when you visit our website.

We use this information to administer our website, for systems improvements and maintenance, to review and evaluate the performance and effectiveness of our website and marketing measures, and to identify usage trends.

Geolocation data, including your general geographic location or more precise location when permitted by law.

You may provide this information to Analysis Group or our service providers when you visit our website.

We use this information to administer our website, and for systems improvements and maintenance.

 

In the preceding 12 months, we have not sold any California residents’ personal information.  We do allow certain service providers, like Google Analytics, to collect information about consumers directly through our Site for purposes of analyzing and optimizing our Site and services.  You may opt out of Google Analytics here.

In the preceding 12 months, we have disclosed for a business purpose the following categories of personal information about California residents:  identifiers, California customer records information, professional/employment information, internet/network information, and geolocation data.  We have shared this information with our service providers who handle information on our behalf.
